  • New DPW medical guidance on ME/CFS

On Monday 9 July the ME Association was sent the final version of new medical guidance on ME/CFS that has been prepared by the Department for Work and Pensions. This will shortly come into effect in relation to applications for Disability Living Allowance and Carer’s Allowance.

The ME Association has made it clear that previous drafts of the guidance have been unfit for purpose and would not help to improve the current situation whereby far too many people with ME/CFS are having to go to appeal in order to obtain DLA.

To read the final draft, which we have not been asked to comment on, see below.

MEA trustees are currently preparing a statement on this final version.

  • Unrefreshing sleep
  • Malaise after exercise lasting more than 24 hours

Other physical causes of fatigue such as anaemia, thyroid disease, sleep apnoea, malignancy, liver disease etc. are excluded

  • A definite history of an acute viral illness like glandular fever at the onset
  • Mild disability and few symptoms
  • Clinical features showing a pattern of evolution towards functional recovery
  • Early diagnosis aimed at eliminating associated physical disorders and/or identifying psychiatric illness, along with other complicating psychological or social factors
  • A management approach which may encompass physical, psychological and social elements that allows a stepwise approach to functional improvement, using rehabilitation

The SSA maintains a list of impairments that are considered so severe that they automatically qualify one for disability benefits as long as all other requirements are met. These conditions are found in the SSAs Blue Book, which describes the medical evidence that is needed to prove the impairment.

You can also be declared disabled if you have a condition that is considered to be equal in severity to a listed impairment.

Even if you dont have a listed impairment or one considered equal in severity to a listed one, you may still be deemed to be disabled if you can show that your medical condition keeps you from working or doing any other type of work.

Recipients By Duration On Income Support And Gender By Those Aged Less Than 50 And Those Aged 50 And Over

Note: Duration on income support includes the period of time a recipient has been on DSP together with the period of time the recipient may have spent on any other income support payment/s prior to being granted DSP. This differs to the methodology used for reports pre 2004.

Duration data contained in the 2004 version of this report counted the time spent on any pension rather than the time spent on any income support payment.

DSP recipients aged 50 years or over make up over half of the total DSP population . These recipients also tend to have been on an income support payment for longer periods than recipients aged less than 50 years .

For Pip Explain Why Aids Or Assistance Wouldnt Help

People with M.E. usually are given 2 points for aids, as though the aids will magically enable you to cook a main meal from fresh ingredients or have a shower whenever you feel like it.

So, if aids or even assistance, wouldnt make a task any easier, you need to explain why that is the case.

For PIP, you are supposed to be assessed on how you are for over 50% of the time.

If you cannot carry out a task for half the week or more, not even with aids or assistance, you should therefore be assessed as being unable to do that task at all.

Couple this with the correct interpretation of the word reliably and many people, particularly those with Severe M.E., should be scoring maximum points on many of the descriptors.

Your medical evidence should talk about your functional ability to carry out each of the tasks being assessed for that particular benefit.

A list of diagnoses and medications is not enough.

Make a double telephone appointment with your GP/ME Nurse/consultant/OT if possible and explain how you are affected.

Ask them to be specific about walking distance that you can manage repeatedly and reliably in their evidence. If they believe improvements are unlikely, ask them to state that in their evidence as it could be used to argue a longer award.

Ssdi Benefits Possible For Sufferers Of Chronic Fatigue Syndrome

While applying for and receiving Social Security Disability Insurance benefits is a challenging process in itself, it is even more difficult for sufferers of Chronic Fatigue Syndrome . It is possible for eligible people with CFS to receive SSDI benefit awards, however, after showing they have a medically determinable impairment, according to Social Security Administration requirements.

What If I’m Not Approved For Disability

It is common that fibromyalgia patients are not approved for disability, especially with the first application. If you are not approved, you’ll have the right to appeal before a judge who specializes in these cases. Some patients with fibromyalgia find it necessary to have the help of an attorney during the appeal process. Although it may increase your costs, the chance your case will be approved is usually better if you have legal counsel.

Appropriate Treatment Is Necessary

Your insurance company will want to see you are receiving appropriate treatment for Chronic Fatigue Syndrome/Myalgic Encephalomyelitis. If your insurance company does not believe you are complying with your doctors recommendations for treatment, they can use this as justification to deny your claim or terminate your benefits.

Unfortunately, there is no known cure for CFS/ME. Therefore physicians focus treatment on managing or mitigating the underlying symptoms of the disease. Some appropriate treatment options include:

Because your insurance company can easily use noncompliance and lack of appropriate care as a reason to deny your claim, you should follow your doctors advice and treatment plan.

Potential Harms To Patients

The reality of surviving with Chronic Fatigue Syndrome | Myalgic Encephalomyelitis (CFS/ME)..

A review in 2019 identified seven possible types of medical harm that patients with CFS may face, and concluded that biopsychosocial model had a focus that was “too narrow” and did not fit the “patient narrative “. A UK treatment programme of psycho-behavioral interventions was found to fail to meet the needs of patients with chronic fatigue syndrome, and to lack oversight. A number of different authors have raised concerns about medical harm to patients, particularly resulting from the use of cognitive behavioral therapy as a primary treatment, the use of graded exercise therapy , and delays in diagnosis.

Concerns have also been raised about a clinical trial of the Lightning Process in children, a treatment not approved for use in adults, and a series of publications have been corrected due to inaccurate ethics statements.

Benefits For Chronic Fatigue Syndrome

Chronic fatigue syndrome refers to several poorly understood medical conditions that can cause extreme fatigue for at least six months.

It is unknown what causes chronic fatigue syndrome, though researchers believe that the condition may be associated with viral infections or immune system issues.

The condition affects all genders, but women are more likely to be diagnosed than men. Many of those diagnosed with chronic fatigue syndrome are around forty to sixty years old.

You may have chronic fatigue syndrome if you experience mental and physical exhaustion frequently over long periods of time. This fatigue will likely interfere with sleeping and other daily activities, often resulting in reduced cognitive functions.

Other symptoms include muscle and joint paint, headaches, and depression. These other symptoms persist episodically for six consecutive months or longer.

Because so little is known about chronic fatigue syndrome, there is no definitive test to diagnose the condition. Doctors must first rule out other medical problems, including sleep disorders, mental disorders, and HIV/AIDS.

This also means that there is difficulty in getting individuals or their families to accept the existence of the condition. Yet the effects can be debilitating while some people with chronic fatigue syndrome can lead ordinary lives, others are unable to leave their bed and are left isolated.

Medical Conditions That Qualify For Disability Benefits

You may be wondering what are the medical conditions that qualify for disability? And is my diagnosis on that list? We give a list of medical conditions below, but as you will learn, any medical condition can potentially qualify for disability benefits. The focus is always on the extent of the disability caused by your medical condition. And whether the extent of your disability meets the requirements for various disability benefits plans and programs. This article lists common disabling conditions. I then review the eligibility criteria for the most common disability benefits. So, you can know if your medical condition can qualify for benefits.

Can I Get Disability Because Of Fibromyalgia

The Americans with Disabilities Act does not contain a list of medical conditions that constitute disabilities. Instead, the ADA has a general definition of disability that each person must meet. Therefore, some people with fibromyalgia will have a disability under the ADA and others will not.

Because fibromyalgia is difficult to diagnose — typically, health care providers rule out other conditions through a physical exam and various blood tests — it’s important that you do your homework before you apply for disability.

According to federal regulations, to qualify for disability you must prove that you have a severe impairment. You also need to prove that the impairment limits your physical or mental ability to do work.

The Social Security disability regulations define disability as “the inability to do any substantial gainful activity due to your medical or mental problem.” In addition, according to the Social Security Administration, your condition must interfere with basic work-related activities. If it doesn’t, your claim won’t be considered. Instead, Social Security will find that you are not disabled.

The combined effect of having multiple impairments is taken into account. That can be important for many people with fibromyalgia. You must be unable to do your previous work or any other substantial gainful activity. Your age and education are considered, as well as your remaining abilities and your work experience.

What’s A Medically Determinable Impairment

One or more of the following medical signs, clinically documented for no less than six consecutive months, will generally be considered evidence that CFS is a medically determinable impairment:

  • tender or swollen lymph nodes on exam
  • nonexudative pharyngitis
  • chronic and reproducible muscle tenderness over multiple exams, with positive tender points
  • positive mental status exam findings, and/or
  • any other indicators of CFS that are medically accepted and consistent with the evidence in your case.

Although the ruling notes the absence of any definitive lab testing for CFS, it provides that any of the following laboratory findings will establish the presence of a MDI:

  • elevated antibody titers to Epstein-Barr virus
  • abnormal MRI brain scan
  • tilt table testing showing neurally mediated hypotension, and/or
  • results of psychological testing.

Under Social Security Ruling 14-1p, medical evidence of CFS must come from a licensed medical or osteopathic doctor. However, your doctor’s diagnosis of CFS will not, by itself, prove the existence of a medically determinable impairment. The clinic notes must show that your physician reviewed your medical history and performed a physical exam. If your doctor’s records aren’t consistent with a diagnosis of CFS, Social Security may decide you don’t suffer from a MDI.

Research Funding Diversion At The Cdc

In 1998, William Reaves, a director at the Centers for Disease Control , alleged deceptive Congressional testimony was given by officials at the agency concerning CFS research activities conducted by the organization specifically, funds for programs intended for CFS research were diverted to other projects and not reported. He also stated he was retaliated against by his superior, Brian Mahy, after he reported the irregularities.

A Government Accounting Office investigation disclosed almost 13 million dollars for CFS research had been redirected or improperly accounted for by the CDC. The agency stated the funds were redistributed in order to respond to other public health emergencies. The director of a U.S. national patient advocacy group charged the CDC had a bias against studying the disease.

In response, the CDC pledged reforms to accounting practices to reduce misuse of funds earmarked for specific diseases. Additionally, the money diverted from CFS research was to be restored over a period of three years.

Me/cfs Disability Benefits For Veterans

A lot of people dont believe veterans when they say they have Chronic Fatigue Syndrome because its a rule-out condition. Its often diagnosed after ruling out things like HIV/AIDS, mental health conditions, other health problems that could be affecting sleep, and simple insomnia. Since it is that type of condition, it can be hard to get a clear chronic fatigue syndrome disability rating.

Treatment for CFS is just as tricky as the diagnosis. Sometimes you can be prescribed painkillers or anti-depressants often treating the most notable symptoms that might be causing it. Exercise, physical therapy, and counseling might also be ordered, but again that is to treat the symptoms that surround the sleep difficulties.
