On Monday 9 July the ME Association was sent the final version of new medical guidance on ME/CFS that has been prepared by the Department for Work and Pensions. This will shortly come into effect in relation to applications for Disability Living Allowance and Carer’s Allowance.
The ME Association has made it clear that previous drafts of the guidance have been unfit for purpose and would not help to improve the current situation whereby far too many people with ME/CFS are having to go to appeal in order to obtain DLA.
To read the final draft, which we have not been asked to comment on, see below.

- Unrefreshing sleep
- Malaise after exercise lasting more than 24 hours
Other physical causes of fatigue such as anaemia, thyroid disease, sleep apnoea, malignancy, liver disease etc. are excluded
- A definite history of an acute viral illness like glandular fever at the onset
- Mild disability and few symptoms
- Clinical features showing a pattern of evolution towards functional recovery
- Early diagnosis aimed at eliminating associated physical disorders and/or identifying psychiatric illness, along with other complicating psychological or social factors

Note: Duration on income support includes the period of time a recipient has been on DSP together with the period of time the recipient may have spent on any other income support payment/s prior to being granted DSP. This differs to the methodology used for reports pre 2004.
Duration data contained in the 2004 version of this report counted the time spent on any pension rather than the time spent on any income support payment.
DSP recipients aged 50 years or over make up over half of the total DSP population . These recipients also tend to have been on an income support payment for longer periods than recipients aged less than 50 years .

People with M.E. usually are given 2 points for aids, as though the aids will magically enable you to cook a main meal from fresh ingredients or have a shower whenever you feel like it.
So, if aids or even assistance, wouldnt make a task any easier, you need to explain why that is the case.
For PIP, you are supposed to be assessed on how you are for over 50% of the time.
If you cannot carry out a task for half the week or more, not even with aids or assistance, you should therefore be assessed as being unable to do that task at all.
Couple this with the correct interpretation of the word reliably and many people, particularly those with Severe M.E., should be scoring maximum points on many of the descriptors.
Get Relevant Medical Evidence
Your medical evidence should talk about your functional ability to carry out each of the tasks being assessed for that particular benefit.
A list of diagnoses and medications is not enough.
Make a double telephone appointment with your GP/ME Nurse/consultant/OT if possible and explain how you are affected.
Ask them to be specific about walking distance that you can manage repeatedly and reliably in their evidence. If they believe improvements are unlikely, ask them to state that in their evidence as it could be used to argue a longer award.

A UK treatment programme of psycho-behavioral interventions was found to fail to meet the needs of patients with chronic fatigue syndrome, and to lack oversight. A number of different authors have raised concerns about medical harm to patients, particularly resulting from the use of cognitive behavioral therapy as a primary treatment, the use of graded exercise therapy , and delays in diagnosis.
Concerns have also been raised about a clinical trial of the Lightning Process in children, a treatment not approved for use in adults, and a series of publications have been corrected due to inaccurate ethics statements.

Benefits For Chronic Fatigue Syndrome
Chronic fatigue syndrome refers to several poorly understood medical conditions that can cause extreme fatigue for at least six months.
It is unknown what causes chronic fatigue syndrome, though researchers believe that the condition may be associated with viral infections or immune system issues.
The condition affects all genders, but women are more likely to be diagnosed than men. Many of those diagnosed with chronic fatigue syndrome are around forty to sixty years old.

Recipients By Medical Condition
With the introduction of the Disability Reform Package in November 1991those on the Invalid Pension were transferred to DSP. These recipients did not have a medical condition recorded on their Centrelink record. While they are being progressively reviewed and ascribed a medical condition, at June 2005 ex-Invalid Pension recipients without a medical condition recorded on their Centrelink record made up 3.4% of the total DSP population.

What’s A Medically Determinable Impairment
One or more of the following medical signs, clinically documented for no less than six consecutive months, will generally be considered evidence that CFS is a medically determinable impairment:
- tender or swollen lymph nodes on exam
- nonexudative pharyngitis
- chronic and reproducible muscle tenderness over multiple exams, with positive tender points
- positive mental status exam findings, and/or
- any other indicators of CFS that are medically accepted and consistent with the evidence in your case.
Although the ruling notes the absence of any definitive lab testing for CFS, it provides that any of the following laboratory findings will establish the presence of a MDI:
- elevated antibody titers to Epstein-Barr virus
- abnormal MRI brain scan
- tilt table testing showing neurally mediated hypotension, and/or
- results of psychological testing.
Under Social Security Ruling 14-1p, medical evidence of CFS must come from a licensed medical or osteopathic doctor. However, your doctor’s diagnosis of CFS will not, by itself, prove the existence of a medically determinable impairment. The clinic notes must show that your physician reviewed your medical history and performed a physical exam. If your doctor’s records aren’t consistent with a diagnosis of CFS, Social Security may decide you don’t suffer from a MDI.
Research Funding Diversion At The Cdc
In 1998, William Reaves, a director at the Centers for Disease Control , alleged deceptive Congressional testimony was given by officials at the agency concerning CFS research activities conducted by the organization specifically, funds for programs intended for CFS research were diverted to other projects and not reported. He also stated he was retaliated against by his superior, Brian Mahy, after he reported the irregularities.
A Government Accounting Office investigation disclosed almost 13 million dollars for CFS research had been redirected or improperly accounted for by the CDC. The agency stated the funds were redistributed in order to respond to other public health emergencies. The director of a U.S. national patient advocacy group charged the CDC had a bias against studying the disease.
In response, the CDC pledged reforms to accounting practices to reduce misuse of funds earmarked for specific diseases. Additionally, the money diverted from CFS research was to be restored over a period of three years.
